OmniSol Information Technology websites, including osit.co.za and verifyid.io renders the services offered at www.verifyid.io ("the service(s)") or sub locations and domains ("website/s") subject to the following standard terms of doing business with us. If you have any questions, please contact support. By utilising any of our services, you expressly ACCEPT the TERMS AND CONDITIONS contained on this page. As Internet subscriber (you will hereafter be referred to as "The Client"), you hereby legally accept and bind yourself to all Terms and Conditions of these services and agree to all acknowledgements, terms and conditions contained in this page. The personal details, including, but not limited to your Verified Name/s, Surname, ID details, Mobile telephone number and E-mail address is kept on our Database and can be viewed in your online Account Profile, which is located at www.verifyid.io after you log into your VerifyID account.
Interpretation and Definitions
Interpretation
The words of which the initial letter is capitalized have meanings defined under the following conditions. The following definitions shall have the same meaning regardless of whether they appear in singular or in plural.
Definitions
For the purposes of these Terms and Conditions:
- Affiliate means an entity that controls, is controlled by or is under common control with a party, where "control" means ownership of 50% or more of the shares, equity interest or other securities entitled to vote for election of directors or other managing authority.
- Account means a unique account created for You to access our Service or parts of our Service. Client refers to user of this website and services.
- Country refers to: South Africa
- Company (referred to as either "the Company", "We", "Us" or "Our" in this Agreement) refers to OmniSol Information Technology PTY LTD, Unit7, Building 2, Silver Woods Office Park, Pretoria, 0081.
- Consent permission for something to happen or agreement to do something.
- Device means any device that can access the Service such as a computer, a cellphone or a digital tablet. Feedback means feedback, innovations or suggestions sent by You regarding the attributes, performance or features of our Service. NCA means the National Credit Act, 34 of 2005 together with the Regulations.
- Prescribed Information shall bear the meaning set out in Section 18 (6) of the Regulations being (a) status and history of outstanding obligations and payments in respect of goods, services or utilities supplied to consumers; (b) information that is relevant for the purposes of credit fraud detection and prevention; (c) payments made by a consumer in respect of a debt, where the debt has been ceded or sold by the credit provider; (d) information that is not related to and not intended for the purpose of providing consumer credit, provided that the consumer’s consent has been obtained to use the information for such purposes and to submit, compile and report such information.
- Prescribed Purpose shall bear the meaning set out in Section 18 (4) and 18(6) of the Regulations being (a) an investigation into fraud, corruption or theft, provided that the South African Police Service or any other statutory enforcement agency conducts such an investigation; (b) fraud detection and fraud prevention services; (c) considering a candidate for employment in a position that requires trust and honesty and entails the handling of cash or finances, provided that the consent of the consumer has been obtained prior to the report being requested; (d) an assessment of the debtors book of a business for the purposes of (i) the sale of the business or debtor’s book of that business; or (ii) any other transaction that is dependent upon determining the value of the business or the debtors book of that business (e) setting in respect of the supply of goods, services or utilities provided that the consent of the consumer has been obtained prior to the report being requested (f) assessing an application for insurance, provided that the consent of the consumer has been obtained prior to the Report being requested; (g) verifying educational qualifications and employment provided that the consent of the consumer has been obtained prior to the Report being requested; (h) obtaining consumer information to distribute unclaimed funds, including pension funds and insurance claims; (i) tracing a consumer by a credit provider in respect of a credit agreement entered into between the consumer and the credit provider; (j) developing a credit scoring system by a credit provider or credit bureau.
- Regulations means the National Credit Regulations, published in Government Gazette No. 8477, Notice 28864 and such other Regulations promulgated in terms of the NCA from time to time. Service refers to the Website.
- Terms and Conditions (also referred as "Terms") mean these Terms and Conditions that form the entire agreement between You and the Company regarding the use of the Service.
- Third-party Social Media Service means any services or content (including data, information, products or services) provided by a third party that may be displayed, included or made available by the Service.
- Website refers to VerifyID, accessible from https://www.verifyid.io
- You means the individual accessing or using the Service, or the company, or other legal entity on behalf of which such individual is accessing or using the Service, as applicable.
Acknowledgment
These are the Terms and Conditions governing the use of this Service and the agreement that operates between You and the Company. These Terms and Conditions set out the rights and obligations of all users regarding the use of the Service.
Your access to and use of the Service is conditioned on Your acceptance of and compliance with these Terms and Conditions. These Terms and Conditions apply to all visitors, users and others who access or use the Service.
By accessing or using the Service You agree to be bound by these Terms and Conditions. If You disagree with any part of these Terms and Conditions then You may not access the Service.
You represent that you are over the age of 18. The Company does not permit those under 18 to use the Service.
Your access to and use of the Service is also conditioned on Your acceptance of and compliance with the Privacy Policy of the Company. Our Privacy Policy describes Our policies and procedures on the collection, use and disclosure of Your personal information when You use the Application or the Website and tells You about Your privacy rights and how the law protects You. Please read Our Privacy Policy carefully before using Our Service.
The Client acknowledges and agrees, that it will at all times comply with the requirements of the Law, including the National Credit Act of 2005 and any Consumer Protection Act/s and -or any other applicable legislation (to the extent that it is relevant to the Client for the receipt, compilation and reporting of information. Without limiting the generality of the aforegoing, the Client specifically acknowledges and agrees that, when reporting Consumer Credit Information to VerifyID;
The Client acknowledges and agrees that; such information will include all mandatory data, prescribed in Section 19 (1) and Section 19 (2)of the Regulations;
The Client acknowledges and agrees that; it will have taken all reasonable steps to ensure that the information being reported, is accurate,up-to-date, relevant, complete, valid and not duplicated (as contemplated in Section 19 (3) of the Regulations), prior to such reporting;
The Client acknowledges and agrees that; of the nature contemplated in Section 19 (4) of the Regulations, such adverse information will not be submitted, unless and until the Client has given the consumer at least 20 business days notice of its intention to submit such information;
The Client acknowledges and agrees that; where the accuracy of such information, submitted by the Client to VerifyID is challenged, the Client shall not resubmit such information to VerifyID, until such time as the challenge has been finally resolved (in accordance with the procedure enumerated in Section 72 (3) (a) and (b) of the Act);
The Client acknowledges and agrees that; it will take all reasonable steps to ensure that, the information is not in respect of a debt that has prescribed in terms of the Prescription Act 68 of 1969 (as contemplated in Section 19 (5) of the Regulations).
The Client acknowledges and agrees that; it may only request and receive Consumer Credit Information, for purposes contemplated in the Act and the Prescribed Purposes enumerated in Section 18 (4) of the Regulations (read in conjunction with Section 18 (5) where required). As such the Client undertakes to fill in all the required fields in the VerifyID CLIENT AGREEMENT diligently.
The Client acknowledges and agrees that, where the Client is a registered credit provider and enters into, amends or terminates credit agreements, or such credit agreements are satisfied, it shall (where it has elected to disclose same to VerifyID) disclose the information prescribed in Section 69 (2) of the Act, to VerifyID in accordance with the manner,form and times prescribed by the Act. Such information shall thereafter be transmitted by VerifyID to the National Credit Regulator.
The Client acknowledges that it is entitled to submit the Consumer Credit Information and Prescribed Information to VerifyID, for the purpose of VerifyID making such information available to its customers, and that such information is not subject to a duty of confidentiality between the Client and the consumer;
The Client shall immediately bring to the attention of VerifyID any breach or attempted breach of security of which it becomes aware. VerifyID may fully investigate such breach or attempted breach and the Client shall give its full cooperation with such investigation.
The Client agrees to always have obtained consent required by the NCA from all persons (Consumers) and Entities (Businesses) prior to requesting Consumer Credit Information and adhere to the prescribe purposes of pulling reports on our platforms. The Client is aware that the NCA imposes civil and criminal penalties, including fines and imprisonment against anyone who knowingly and wilfully reports or obtains confidential information and/or consumer credit information from a credit bureau under false pretences and for purposes not permitted or prescribed by the NCA.
